Consumer Health Data Privacy Policy

This policy describes how Berkeley Labs LLC handles consumer health data in Bearing, as required by
Washington's My Health My Data Act (chapter 19.373 RCW).
1. Consumer health data we collect, and why
- Lab results and biomarker values you add, by uploading or photographing a lab report, importing a spreadsheet, pasting text, or entering values by hand. Used to show each result against a reference range, explain it in plain language, track it over time, and produce the summaries and doctor-visit PDF you request.
- Health app data you choose to connect, from Apple Health or Health Connect: activity (steps, exercise minutes, active energy), sleep, heart rate, heart rate variability, heart rate recovery, VO₂ max, respiratory rate, blood oxygen, body temperature, blood pressure, glucose, weight, body fat, BMI, and on Android height, used to calculate BMI. Used to show your trends against your own baseline and to write your observations and reviews.
- Sex at birth and date of birth, if you add them. Used to choose the correct reference ranges.
- The lab documents or text you upload. Used only to extract your values. Deleted when you save the results, or automatically within two days if you don't.
- Information derived from the above: whether a result is in range, your trends, explanations, observations and reviews. Used to show them to you, and in the summaries and alerts you choose to turn on.
- App usage events that can reflect a health interest, such as opening a lab result's page (we record only its category, such as "lipids" or "sleep", never the specific marker or its value). Used to understand and improve how the app is used.
2. Where this data comes from
- Directly from you: what you upload, paste, enter or add to your profile.
- From Apple Health or Health Connect, only if you connect them, and only the categories you permit.
- Generated by Bearing from the above, including by our AI provider acting on our behalf.
3. Consumer health data we share
We do not sell consumer health data, and we do not share it with third parties or affiliates. We
disclose it only to processors that handle it on our behalf, under contract, to provide Bearing: cloud
hosting and storage, AI processing of lab reports and explanations, product analytics, crash reporting,
email delivery and push notification delivery.
4. Third parties and affiliates we share it with
None.
5. Your rights and how to use them
You have the right to:
- confirm whether we collect, share or sell your consumer health data, and access it, including a list of all third parties and affiliates we have shared or sold it with;
- have it deleted, including from our processors and backup systems; and
- withdraw your consent to its collection and sharing.
In the app, Settings → Export my data gives you your data,
Delete all biomarker data or Delete account deletes it, and disconnecting
Apple Health or Health Connect stops collection from them. You can also email
support@heybearing.com with "Consumer health data request" in the
subject line, from the email address on your account so we can verify the request is yours. We respond
within 45 days. If we need longer, we may extend that once by 45 days and will tell you. Requests are
free up to twice a year.
Appeals. If we decline to act on your request, you can appeal by replying to our decision
or emailing support@heybearing.com with "Appeal" in the subject
line. We will respond in writing within 45 days, explaining any action taken or not taken and why. If we
deny your appeal, you can contact the Washington State Attorney General at
atg.wa.gov/file-complaint.
